tootcars.com (“TootCars”, the “site”) is operated by The Motorists Organisation Ltd (“TMO”, “we”, “us” or “our”). TMO is registered in England and Wales (Company No. 08339147). Registered office: 1000 Lakeside, Western Road, Portsmouth, PO6 3EN, United Kingdom. BookMyGarage is a trading name of The Motorists Organisation Ltd.

TootCars provides an online platform that allows users to browse vehicles advertised for sale and make enquiries about those vehicles.

We do not provide any advice in relation to the services compared on the site, nor do we provide any recommendations or endorsements.

Any vehicle recommendations displayed on the site are automated suggestions intended to help users explore options and do not constitute advice, recommendations or endorsements.

We do not sell the vehicles displayed on TootCars and, unless expressly stated otherwise, we do not own them. Vehicles are offered for sale by the relevant motor dealer, retailer or other seller (“Seller”).

TMO are registered in England and Wales under company number 08339147 and have our registered office at Suite 216, 1000 Lakeside, Western Road, Portsmouth, England, PO6 3EN.

By using our site you accept these terms

By using TootCars, you confirm that you accept these terms of service and agree to comply with them.

If you do not agree to these terms, you must not use our site.

We may transfer this Agreement to someone else

We may transfer our rights and obligations under these terms to another organisation.

We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

Our site is only for users in the UK

Our site is directed to people residing in the United Kingdom. We do not represent that content available on or through our site is appropriate for use or available in other locations.

You must keep your account details safe

If you choose, or are provided with, a user identification code, password or other information as part of our security procedures, you must treat it as confidential and must not disclose it to any third party.

We may disable any user identification code or password if, in our reasonable opinion, you have failed to comply with these terms.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us.

Your use of our vehicle search and enquiry facility

The following definitions apply:

· Seller means a motor dealer, retailer or other seller offering a vehicle for sale through the site.

· User means a person, also referred to as “you”, who visits or uses the site, browses vehicles or makes an enquiry.

· Vehicle Enquiry means a request submitted through the site for information or contact regarding a vehicle.

About vehicle listings

Vehicle information, pricing, imagery and availability displayed on TootCars is supplied by Sellers or their data providers and may change without notice.

We do not independently inspect every vehicle or verify every piece of information supplied by a Seller.

You should confirm any information important to your decision directly with the Seller before entering into a transaction.

We do not guarantee that any vehicle displayed on the site will remain available.

Vehicle enquiries

TootCars allows you to submit an enquiry or request contact regarding a vehicle.

When you make a Vehicle Enquiry, the information you provide may be sent to the Seller responsible for the relevant vehicle so that they can respond to you. The Seller may contact you using the contact details you provide, including by telephone, email or text message.

Telephone numbers displayed on TootCars may connect through our telephony providers and calls may be recorded. Where calls are recorded, you will be informed before recording begins. Further information is contained in our Privacy Policy.

Submitting an enquiry or calling a Seller does not reserve the vehicle, constitute an offer to purchase, require the Seller to sell the vehicle to you, guarantee that the vehicle remains available, or create a vehicle purchase contract between you and TMO.

Your relationship with the Seller

Any negotiation, reservation, deposit, finance agreement, part exchange, purchase or other transaction relating to a vehicle is between you and the relevant Seller and may be subject to the Seller’s own terms and conditions.

TMO is not a party to that transaction.

The Seller is responsible for the vehicle, the accuracy of information it provides, its communications with you and compliance with its legal obligations when selling the vehicle.

Before entering into a transaction, you are responsible for satisfying yourself that the Seller and vehicle are suitable for you, that important information is accurate, and that you understand the Seller’s terms and any price, charges, warranty, finance, inspection, test drive or part-exchange arrangements.

Nothing in these terms affects any statutory rights you may have against a Seller.

No endorsement

The presence of a Seller or vehicle on TootCars does not constitute an endorsement, recommendation or guarantee by TMO.

We do not guarantee the identity, financial standing or conduct of a Seller; that a vehicle is suitable or free from defects; that listing information is complete or accurate; that a vehicle will remain available; that a Seller will respond; or that a transaction will be completed.

You are responsible for deciding whether to proceed with a Seller or vehicle.

Your obligations

You are responsible for ensuring that all information required for the site to process and direct your Vehicle Enquiry is provided. You confirm that all information provided by you through the site is true and accurate and that no information given, or omission made, is intended or likely to mislead or deceive any person or organisation. TMO reserves the right, at its discretion, to request verification of, or verify on your behalf, any information provided by you.

· We may terminate or restrict your use of the site and/or cancel or prevent any Vehicle Enquiry, without notice, where:

· information provided by you is incomplete, invalid, untruthful or incorrect;

· you use the site to send spam, submit false enquiries or undertake suspicious, fraudulent or potentially abusive activity, including activity identified from technical data such as IP address information;

· you provide false information about your identity or impersonate another person;

· you are abusive towards any Seller, its personnel, TMO personnel or another user;

· you interfere with, undermine or attempt to compromise the integrity, security or operation of the site, introduce malicious code, or attempt to gain unauthorised access to the site or related systems;

· you scrape, copy or systematically extract data from the site without our permission; or

· you otherwise use the site unlawfully or in breach of these terms.

You acknowledge that communications sent to you by a Seller, and their content, are the responsibility of that Seller and are not a recommendation or endorsement by TMO or any of its directors, employees or related parties. The Seller is solely responsible for the accuracy and suitability of its communications and any offer it makes. You should contact the Seller for further information and must deal directly with the Seller regarding complaints or enquiries relating to its communications, the vehicle or any proposed transaction. You are responsible for agreeing directly with the Seller any inspection, test drive, reservation, deposit, finance, part exchange, collection, delivery or other arrangements, including any associated costs.

How you may use material on our site

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of pages from our site for your personal use and may draw the attention of others within your organisation to content posted on our site.

You must not modify paper or digital copies of materials you have printed or downloaded, and must not use illustrations, photographs, video or audio sequences or graphics separately from accompanying text.

Our status, and that of identified contributors, as authors of content on our site must always be acknowledged, except where content is user-generated.

You must not use any part of the content on our site for commercial purposes without obtaining a licence from us or our licensors.

If you print, copy, download, share or repost any part of our site in breach of these terms, your right to use the site will cease immediately and you must, at our option, return or destroy copies you have made, except that you may print a copy of these terms.

Our trade marks are registered

You are not permitted to use TMO or TootCars trade marks without our approval.

Do not rely on information on this site

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

Although we make reasonable efforts to update information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content is accurate, complete or up to date.

You should not rely solely on information displayed on TootCars when making a vehicle purchase decision.

We are not responsible for websites we link to

Where our site contains links to other sites and resources provided by third parties, including Sellers, these links are provided for your information only. They should not be interpreted as approval by us of those websites or information you may obtain from them.

We have no control over the contents of those sites or resources.

We are not responsible for viruses

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programs and platform to access our site. You should use your own virus protection software.

You must not knowingly introduce viruses, malware or other harmful material or attempt to gain unauthorised access to our systems.

Our responsibility for loss or damage suffered by you

Whether you are a consumer or a business user:

· We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

· We shall have no liability to you whatsoever in respect of the negotiation, reservation, deposit, finance, part exchange, purchase, collection, delivery or performance of any agreement between you and a Seller. You agree that we do not supervise, direct, control or monitor a Seller in the performance of its contractual or legal obligations. The Seller is responsible for the vehicle and for performing its obligations to you.

· In recognition that we are not a party to any contract between you and a Seller, you release us, to the extent permitted by law, from claims, demands and damages of every kind arising out of or connected with any dispute you have with a Seller. This includes, without limitation, disputes concerning a Seller’s acts or omissions, the description, condition, quality, safety, suitability, availability or price of a vehicle, the accuracy of information supplied by a Seller or third-party data provider, a Seller’s failure to respond, negotiations, deposits, finance, part exchange, warranties, delivery, refunds or the performance of any agreement. This release does not apply to any claim arising from our failure to meet our own obligations under these terms or to any liability that cannot lawfully be excluded.

· You acknowledge that use of the internet can be unstable and sometimes insecure. The site may not always be available, Vehicle Enquiries may not be processed or received, and a Seller may not respond or may no longer have the vehicle available. In these circumstances TMO accepts no responsibility, except where responsibility cannot lawfully be excluded.

If you are a business user:

· We only provide our site for domestic and private use. If you do use our site as a business, then the exclusions in this clause shall apply to the fullest extent.

· You acknowledge and agree that you are solely responsible for evaluating and determining the suitability of any Seller or vehicle, assessing whether to enter into a contract with the Seller for the applicable vehicle and verifying any information provided by the Seller or displayed on the site.

· We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.

· We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

· use of, or inability to use, our site;

· use of or reliance on any content displayed on our site;

· use of the site to search for a Seller or vehicle or to submit a Vehicle Enquiry; or

· any vehicle, service or agreement provided, offered or entered into by a Seller.

· In particular, we will not be liable for:

· loss of profits, sales, business, or revenue;

· business interruption;

· loss of anticipated savings;

· loss of business opportunity, goodwill or reputation; or

· any indirect or consequential loss or damage.

If you are a consumer user:

· We only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

How we may use your personal information

We will only use your personal information as set out in our Privacy Policy.

Which country’s laws apply to any disputes?

· If you are a consumer, these terms, their subject matter and formation are governed by English law. The courts of England and Wales will have jurisdiction, except that if you are resident in Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident in Scotland you may also bring proceedings in Scotland.

· If you are a business, these terms, their subject matter and formation, including non-contractual disputes or claims, are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
